Frequently Asked Questions
Is a revenue stamp required on rent receipts in India?
A revenue stamp is legally required if the rent amount exceeds ₹5,000 per receipt and is paid in cash. If the payment is made digitally (UPI, bank transfer, cheque, or card), a revenue stamp is not required under Section 30 of the Indian Stamp Act, as digital transactions leave a verifiable audit trail.
Can I claim HRA if my landlord is my parent?
Yes, you can pay rent to your parents and claim HRA. However, the transaction must be genuine: you should sign a rent agreement, transfer the rent via bank channels monthly, and your parents must declare this rent as rental income in their ITR under 'Income from House Property'.
What happens if my landlord does not have a PAN?
Under Income Tax rules, declaring your landlord's PAN is mandatory if your total rent payments exceed ₹1,00,000 during the financial year. If your landlord does not hold a PAN, you must obtain a signed Form 60 declaration from them stating they do not have a PAN, along with their consent.
